Terms of Service Agreement

Welcome to VITIN – the short URL service provided by VAUCH Information Technology Private Limited ("We", "Us", "Our"). By accessing or using our services, you ("Customer", "You", "Your") agree to the following terms and conditions ("Agreement"). Please read this Agreement carefully before using our services.

1. Acceptance of Terms

By using VITIN services, you agree to be bound by this Agreement. If you do not agree to these terms, you are not permitted to use our services. This Agreement may be updated from time to time, and the latest version will be posted on our website. Continued use of the service constitutes your acceptance of the updated terms.

2. Services Provided

VITIN offers a platform to create, manage, and share short URLs for business purposes. You are responsible for ensuring that your use of our services complies with all applicable laws, including TRAI guidelines.

3. Compliance with TRAI Guidelines

You agree to comply with the following regulations as mandated by the Telecom Regulatory Authority of India (TRAI):

• 3.1 Whitelisting of URLs: Any URLs shared through SMS, APKs, OTT links, or callback numbers must be whitelisted with the Distributed Ledger Technology (DLT) platform. You must provide accurate and complete information for this process.
• 3.2 DLT Registration: You are required to register on the DLT platform as per TRAI regulations and ensure that your communication headers and content templates are compliant.
• 3.3 Message Traceability: From 1st October 2024, all messages sent using our services must be traceable from the sender to the recipient. Any message with undefined or mismatched sender details will be rejected.
• 3.4 Prohibited Content: You are prohibited from transmitting messages containing URLs, APKs, OTT links, or callback numbers that are not whitelisted. You must not use our services for illegal, misleading, or fraudulent purposes.
• 3.5 Content Templates: All content templates must be registered correctly under the appropriate categories. Registering templates under incorrect categories may result in penalties or suspension of services as per TRAI directives.

4. Service Suspension and Termination

We reserve the right to suspend or terminate your use of VITIN services without notice if:

• You violate any TRAI guidelines or fail to provide accurate whitelisting information.
• You misuse the service by sending fraudulent or non-compliant messages.
• Any misuse of headers or content templates is discovered.

In such cases, services will only be reinstated upon verification and legal action against misuse, if required.

5. Customer Responsibilities

• 5.1 Account and URL Management: You are responsible for maintaining the accuracy and security of your account and the URLs you generate. You must ensure that your usage of the URLs complies with this Agreement.
• 5.2 Reporting Misuse: You must report any misuse or breach of the terms of this Agreement within two business days of discovering the issue. Failure to report may result in suspension of services.
• 5.3 Legal Compliance: You must ensure that your communications do not violate any laws, including those set by TRAI and other relevant authorities.

6. Indemnity

You agree to indemnify and hold VAUCH Information Technology Private Limited harmless against any claims, damages, or penalties arising from your non-compliance with TRAI regulations or misuse of VITIN services.

7. Limitation of Liability

We are not liable for any direct, indirect, or consequential damages arising out of your use of VITIN services. This includes, but is not limited to, issues related to message delivery, service interruptions, or penalties imposed by regulatory authorities.

8. Termination of Services

We may terminate or suspend your access to the VITIN service at any time, with or without cause, and without prior notice. You may also terminate this Agreement by ceasing to use the service.

9. Governing Law

This Agreement is governed by the laws of India. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Mumbai.

By using the VITIN short URL service, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
